In this increasingly litigious world, it becomes ever more important
to ensure that you are protected against your costs of an action
be brought against you. Some such actions may well seem absurd
and an obvious "try-on" but, if accused, you still need
professional representation - and this can be expensive.
Motorsport has its own complexities. It appears that many are
still under the misapprehension that the organisers' own policy
will cover a team or its drivers but this is not so. Remember
that the organisers arrange a policy in order to protect their
liability, not yours. That is their prime objective.
Individual liability of a driver to fellow competitors remains
a moot point and there is a general reluctance amongst the insurance
industry to make it widely available or, indeed, to "hard
sell" any cover for individuals as it could set a dangerous
precedent. The phrase "ambulance chasing" comes to mind,
especially when considering the advertisements now in the media
"where there is an accident, there is blame - therefore compensation!"
Guess who will pay in the long term? Nevertheless, we are occasionally
able to find a market for this coverage, although it is expensive.
For teams, we suggest a "contingent liability" policy.
We are aware of the incidence of pit-lane accidents and we feel
that it is sensible to provide coverage should there be an action
for negligence. Our policies indemnify the team, its sponsors,
drivers, team members and official helpers in respect of their
legal liability for death or injury to third parties, or damage
to third party property following an accident arising out of the
normal activities of the assured.
We also have specialised packages for all club event organisers,
promoters and operators, whether two- or four-wheeled, including
karts and track-day operators.
